MERS is facing another qui tam lawsuit in New Jersey. The case was originally filed in state court in July 2012, but has now been removed to federal court. Qui tam means that the suit is brought by a private individual on behalf of both himself and the government (the State). From what I've seen, most such qui tam suits get dismissed for technical reasons (plaintiff is unable to show that he can sue on behalf of the State). Every case, however, is different.
